2. The sections of these Acts which provide for "exemplary" punishment, i.e. a maximum of 14 years penal servitude, are not Sections under which would lie a prosecution along the lines of that brought against Compton Mackenzie. 3. His case, which was something in the nature of a test case, under the Acts, was brought under a Section which provides a maximum penalty of two years imprisonment and a fine or both. 4. It is thought that a prosecution started in an atmosphere of general relief at the end of hostilities will meet with only the most meagre approval and Courts, far from being ready to impose a maximum penalty, will treat cases under existing legislation with egregious leniency.
